Total Weight Loss Group Coaching Terms and Participant Agreement

This Terms and Participant Agreement (the "Agreement") is between you ("Member," "you") and Total Weight Loss ("Company," "we," "us"), with coaching led by Dr. Johnny Hadac ("Coach"). It governs your participation in the Total Weight Loss Group Coaching program (the "Program").

By checking the box at signup and completing your purchase, you confirm that you have read, understand, and agree to every term in this Agreement. If you do not agree, do not enroll.

IMPORTANT: The Program is education and coaching only. It is NOT medical care. Dr. Hadac is NOT acting as your physician. No doctor patient relationship is created by joining, paying for, or participating in the Program.

1. Eligibility

You must be at least 18 years old to enroll. By enrolling, you confirm that all information you provide is true, accurate, and complete, and that you will keep it updated.

2. What the Program Includes

For each 30 day period you are enrolled, you receive:

  • Access to a private online community with the Coach and other Members.
  • One scheduled onboarding call, booked by you within the booking window provided after enrollment.
  • A personalized 30 day plan built from the information you provide on your intake form. This may include daily habit targets, recipes, workouts, macro targets, and general lifestyle guidance.
  • Educational content, accountability, and general support inside the community.

The Company may update or improve Program content, tools, and format at any time. Program features do not include one on one access to the Coach outside of what is listed above.

3. Not Medical Care. No Doctor Patient Relationship.

Although Dr. Hadac is a licensed physician, he is participating in this Program solely as an educator and coach. You understand and agree that:

  • No doctor patient relationship is formed between you and Dr. Hadac or anyone affiliated with the Company.
  • The Program does not diagnose, treat, cure, monitor, or prevent any disease or medical condition.
  • The Program does not include medical exams, lab ordering or interpretation, prescriptions, medication management, or any change to any medication or treatment you currently use.
  • All information shared in the Program, including your 30 day plan, calls, posts, and messages, is general education only and is NOT medical advice.
  • Nothing in the Program replaces care from your own physician or licensed healthcare provider.
  • Any healthcare services Dr. Hadac may provide elsewhere are offered through a separate entity, under a separate agreement, and are not part of this Program.

4. Your Health and Your Responsibility

  • You agree to consult your own physician before starting any nutrition, exercise, fasting, or supplement change, especially if you are pregnant, nursing, taking medications, or have any medical condition, including diabetes, heart, kidney, or liver disease, or a history of disordered eating.
  • You are solely responsible for your health decisions and for deciding whether any recommendation is right for you.
  • Stop any activity and seek medical care if you experience pain, dizziness, shortness of breath, or any other concerning symptom.
  • The Program is not for emergencies. If you have a medical emergency, call 911 or go to the nearest emergency room. Do not use the community or messages for urgent health needs.

5. Your Commitment

Results depend on your effort. By enrolling, you agree to make your best effort to follow your 30 day plan, participate in the community, attend your scheduled call, and complete the actions assigned to you during the 30 days. The Company is not responsible for results you do not achieve due to lack of participation.

6. Fees and Renewal

  • Initial enrollment: $500 for your first 30 day period, paid in full at signup.
  • Optional renewal: After your first 30 days, you may choose to renew for $100 per 30 day period.
  • If you choose to renew, your renewal is billed every 30 days to your payment method on file until you cancel.
  • All prices are in US dollars. The Company may change future renewal pricing with advance notice to you.

7. Cancellation and Refunds

You may cancel at any time. Cancellation stops future renewal charges. All cancellation and refund requests must be made in writing by email to info@shoptotalweightloss.com.

  • Within the first 5 days of enrollment: submit a written refund request and you receive a full refund of $500.
  • After the first 5 days of your initial 30 day period: you are eligible for a partial refund only. The Company keeps $250 and refunds you $250.
  • Renewal payments ($100) are non refundable. Canceling stops the next renewal charge, and you keep access through the end of the period you paid for.
  • Refund requests not received in writing will not be processed. Verbal requests, community posts, and direct messages on social media do not count.
  • Approved refunds are returned to your original payment method.

8. Scheduled Calls

After enrollment, you will receive a link to book your onboarding call within the booking window provided. It is your responsibility to book and attend. Missed calls will not be rescheduled, and a missed or unbooked call does not qualify you for any refund, credit, or extension.

9. The Company's Right to Remove Members

The Company may, at its sole discretion and at any time, determine that you are not a good fit for the Program and end your participation. If the Company ends your participation for fit, it may issue a full or partial refund at its sole discretion. If you are removed for violating this Agreement or the Community Guidelines, no refund is owed.

10. Privacy and Confidentiality

  • Your intake information, health details, and private messages to the Coach are kept confidential and are used only to deliver your Program.
  • We will never sell your information and will not share your personal health information with anyone outside the Company's coaching team without your permission, except where required by law or where we reasonably believe someone is at risk of serious harm.
  • If you use the Total Weight Loss app as part of the Program, the Coach may review your logged progress, such as food logs, weight trends, workouts, and activity, to prepare for coaching. You consent to this review by enrolling.
  • Because the Program is not medical care, information you share is not a medical record and is handled under this Agreement and the Company's Privacy Policy at https://shoptotalweightloss.com/policies/privacy-policy.
  • The community is shared. Anything you post in the group can be seen by other Members. Only share in the group what you are comfortable having others see. Share anything private directly with the Coach instead.
  • No method of online storage is completely secure. We use reasonable safeguards but cannot guarantee absolute security.

11. Community Guidelines

To keep the group safe and supportive, you agree to:

  • Treat every Member with respect. No harassment, shaming, or discrimination.
  • Keep what other Members share confidential. Do not screenshot, record, or repost anything from the community or calls.
  • Not give medical advice to other Members or promote your own products or services.
  • Not share Program materials with anyone outside the Program.

12. Products and Financial Interest

Your plan may reference the Total Weight Loss app, cookbook, and Muscle Dummies supplements. The Coach has a financial interest in these products. Using them is always optional and is never required to participate. Supplements are not intended to diagnose, treat, cure, or prevent any disease. Check with your physician before using any supplement.

13. No Guarantee of Results

Every person is different. The Company makes no promise or guarantee of any specific weight loss, health outcome, or result. Testimonials and examples shared in the Program are not typical and do not guarantee your results.

14. Assumption of Risk and Release

You understand that changes to diet, exercise, and lifestyle carry inherent risks, including injury and health complications. You voluntarily assume all such risks. To the fullest extent allowed by law, you release the Company, Dr. Hadac, and their owners, employees, contractors, and affiliates from any and all claims, injuries, losses, or damages arising from your participation in the Program or your use of any information, product, or recommendation provided.

15. Limitation of Liability

To the fullest extent allowed by law, the Company and Dr. Hadac are not liable for any indirect, incidental, special, or consequential damages, or for any medical condition, injury, or health outcome related to the Program. In no event will total liability exceed the amount you paid for the Program in the 30 days before the claim arose.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Company, Dr. Hadac, and their affiliates from any claims, damages, or expenses, including attorney fees, arising from your participation, your breach of this Agreement, or your conduct in the community.

17. Intellectual Property

All Program materials, including plans, recipes, workouts, videos, and documents, are owned by the Company and are provided for your personal use only. You may not copy, resell, distribute, or share them.

18. Recordings

Group sessions may be recorded for Program use. By attending, you consent to being recorded. You may keep your camera off and use a first name only.

19. Disputes and Governing Law

This Agreement is governed by the laws of the State of Florida. Before filing any claim, you agree to contact the Company in writing and try in good faith to resolve the issue informally for at least 30 days. Any dispute that cannot be resolved will be handled in the state or federal courts located in Manatee County, Florida, and you consent to that jurisdiction.

20. General Terms

  • This Agreement, together with the Privacy Policy, is the entire agreement between you and the Company regarding the Program.
  • If any part of this Agreement is found unenforceable, the rest remains in full effect.
  • The Company may update this Agreement. Updates apply to future renewal periods, and continuing in the Program after notice means you accept them.
  • Your electronic acceptance by checking the box at signup has the same effect as a handwritten signature.

  • I am 18 or older and have read this entire Agreement.
  • I understand this Program is education and coaching only, is not medical care, and Dr. Hadac is not my doctor.
  • I will consult my own physician before making changes, and I will call 911 for any emergency.
  • I understand the $500 fee, the optional $100 renewal, and the written refund policy: full refund within 5 days, $250 partial refund after 5 days.
  • I understand missed calls will not be rescheduled.
  • I accept all risks of participating and agree to the release and limitation of liability.
